Liquidation
There are three types of liquidation procedures we offer advice on to Directors:
- Creditors Voluntary Liquidation
- Compulsory Liquidation
- Members Voluntary Liquidation
We can explain the pros and cons of each procedure and which is best suited to you in the current circumstances.
Administrative Receivership
Administration receivership when an independent receiver is appointed by a secured creditor or, in rare circumstances, by the court, to take control of some or all of the company’s assets.
Individual Voluntary Arrangement (IVA)
Broadly speaking an Individual Voluntary Arrangement (“IVA”) is a contract between the individual debtor and their creditors.
Solvent Liquidation/Members Voluntary Liquidation (MVL)
A Members’ Voluntary Liquidation (MVL) is the voluntary liquidation process available to solvent companies.
Company Voluntary Arrangement (CVA)
Broadly speaking a Company Voluntary Arrangement (“CVA”) is a legally binding contract between the company and its creditors where the owners want to save the business but cannot afford to pay all of the debts due now.
Insolvent Partnerships
If a partnership or one of the partners is facing financial difficulties there are a few options available that we can discuss with the partners.
Administration
Neville & Co help the Directors lodge a notice of intention to appoint Administrators with the Court and send notices to any bank or third party with a debenture. Once the notice period has passed licensed Insolvency Practitioners of Neville & Co are appointed Administrators over the company.
Bankruptcy
Bankruptcy is a procedure available for insolvent individuals who cannot pay their debts.
Partnership Disputes
